Compliance Watchdog (“we”, “us”, “our”) is committed to protecting your privacy. This policy explains how we collect, use, disclose and protect personal information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1Who we are
Compliance Watchdog is an independent compliance-monitoring and investigation-support service for Australia's supplement, health and food sectors. We are not a government agency or regulator.
2The information we collect
We collect personal information that is reasonably necessary for our functions, including:
- Information you give us: your name, email address, and the contents of any report, tip-off or enquiry you submit. A report may include information about businesses, products and individuals that are the subject of that report.
- Information collected automatically: our website is hosted by a third-party provider and our fonts are served by a content-delivery network. These providers may collect technical information such as your IP address, browser type and access times through standard server logs. We do not operate advertising or tracking cookies on this website.
You do not have to identify yourself when submitting a report. However, if you do not provide contact details, we may be unable to follow up with you or update you on the outcome.
3How we use your information
We use personal information to:
- receive, assess and verify reports and enquiries;
- document and substantiate potential non-compliance;
- refer substantiated matters to the appropriate regulator or authority;
- respond to and communicate with you;
- keep records and improve our services; and
- comply with our legal obligations.
4When we disclose information
We may disclose personal information to:
- Australian regulators and authorities, including the Therapeutic Goods Administration (TGA), the Australian Competition and Consumer Commission (ACCC), and state food authorities such as the NSW Food Authority, where necessary to refer or progress a matter;
- law enforcement or government agencies where required or authorised by law;
- our professional advisers (such as lawyers), under obligations of confidentiality; and
- other parties where you have consented or where disclosure is otherwise permitted under the APPs.
We do not sell, rent or trade personal information.
5People who report to us
We take reasonable steps to protect the identity of people who report to us in good faith. We will not disclose your identity as a reporter except where you consent; where it is necessary to substantiate or refer a matter and you have agreed; or where we are required or authorised to do so by law (for example, by a court, or in response to a lawful request from a regulator). Where we reasonably can, we will let you know.
6Information about other people
A report may contain personal information about other individuals. You should only provide information that you are lawfully entitled to share, and that you reasonably believe to be true. We handle that information in accordance with this policy and the APPs.
7Storage and security
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Information is stored securely and retained only for as long as necessary for our functions or as required by law, after which it is destroyed or de-identified.
8Overseas disclosure
Some of our service providers (including our website host and email provider) may store or process data on servers located outside Australia. We take reasonable steps to ensure such providers handle personal information consistently with the APPs.
9Accessing and correcting your information
You may request access to, or correction of, the personal information we hold about you (APP 12 and APP 13). Please contact us at info@compliancewatchdog.com.au. We may need to verify your identity, and some requests may be subject to exceptions under the Privacy Act.
10Complaints
If you believe we have breached the APPs, please contact us at info@compliancewatchdog.com.au and we will respond within a reasonable time. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
11Changes to this policy
We may update this policy from time to time. The current version will always be published on this website, with its “last updated” date.
